In consideration of the services of Tour the West LLC, including its officers, agents, employees, guides, drivers, and all other entities associated with this business (hereafter collectively referred to as "TTW"), I agree to the following:

Acknowledgment of Risks

TTW has taken reasonable steps to provide appropriate vehicles, equipment, and skilled guides to enhance my experience. However, TTW has informed me that participating in a tour and its associated travel is not without risk. Certain risks are inherent to these activities and cannot be eliminated without altering the fundamental character of the experience. These inherent risks contribute to the uniqueness of the tour but may also result in loss or damage to personal property, accidental injury, illness, permanent trauma, or, in extreme cases, death.

TTW does not intend to discourage participation but believes it is important for me to understand and acknowledge these risks. The following outlines some, but not all, of the potential hazards:

• Environmental and Terrain Risks: Slips, trips, and falls due to uneven or rugged terrain; falls into water or from heights; exposure to rivers, streams, lakes, rocks, and unstable ground.

• Wildlife and Natural Elements: Encounters with wildlife, insects, and other animals that may be unpredictable and potentially harmful.

• Weather and Climate Risks: Inclement weather conditions, extreme temperatures, high-altitude effects (including altitude sickness and shortness of breath), and associated dangers such as frostbite, hypothermia, heatstroke, or severe sunburn.

• Food and Beverage Risks: Consumption of food and beverages during the tour may involve the risk of allergens, contamination, or foodborne illness.

Assumption of Risk and Responsibility

I acknowledge that the above list is not exhaustive and that there may be other unanticipated risks associated with my participation. I voluntarily accept full responsibility for any risks, whether identified or not, that could result in personal injury, property damage, illness, or death.

I understand that participation in this experience may require a reasonable level of physical fitness and awareness. I acknowledge that TTW staff have been available to explain the nature and physical demands of the tour, along with the inherent risks. I certify that I am capable of participating and assume full responsibility for myself and any minor children under my care, custody, or control.

By signing this agreement, I waive and release Tour the West LLC, its officers, employees, agents, and affiliated entities from any liability for injuries, damages, or losses incurred as a result of inherent risks, hazards, or my own negligence while participating in this activity.

Medical Authorization and Emergency Care

In the event of illness or injury, I authorize TTW and its representatives to obtain or provide emergency medical care deemed necessary. I understand that TTW does not provide medical insurance and that I am solely responsible for any medical expenses incurred as a result of participation in this experience.

Additional Terms

• Seat Belt Requirement: All guests must wear seat belts while the vehicle is in motion. It is unlawful and unsafe to travel without a seat belt.

• Firearms Policy: Guests are not permitted to carry firearms while participating in any Tour the West experience.

• Child Seat Responsibility: Guardians traveling with minors are solely responsible for complying with all applicable child safety seat laws. If a child seat is required, it must be provided and properly installed by the guardian prior to the start of the tour. TTW does not install child seats and is not responsible for ensuring compliance.

Media Release (Optional but Included)

I grant TTW permission to use photographs, video, or other media taken during the experience for promotional, marketing, and commercial purposes, without compensation, unless I notify TTW in writing prior to the tour.

Cancellation and Policy Acknowledgment

I acknowledge that I have reviewed and agree to TTW’s cancellation and booking policies, which are provided at the time of booking or upon request.

Governing Law and Jurisdiction

I understand that this agreement shall be governed by the laws of the State of Colorado where applicable. I also acknowledge that portions of this experience may take place on federally managed lands, including areas administered by the National Park Service and the United States Forest Service, and are therefore subject to applicable federal laws and regulations. Any legal claims arising from this agreement shall be brought in a court of competent jurisdiction within the State of Colorado unless otherwise required by federal law.

I have carefully read and fully understand this agreement. By electronically typing my name below, I acknowledge that this agreement shall be binding upon me, my heirs, assigns, personal representatives, and estate, as well as any minor children under my care.
